Constitution bill seeks to replace the collegium model of judicial appointments with a Judicial Appointment commission[JAC].
For a constitution amendment to become law when it seeks to make any changes in the "Union Judiciary", it has to undergo these three steps:
- The bill has to be passed by both the house by a majority of not less than 2/3rd members of that house present & voting & majority of the total membership of that house.
- The amendment also requires to ratified by the legislature of not less than one half of the states by a resolution to that effect.
- assent by the president
This bill empower JAC to appoint judges to the supremecourt and high court..
JAC will comprise of six members [chief justice of india,two most senior judges of supremecourt, the law minister & two eminent persons)..... two eminent persons are supposed to be appointed by collegium comprising prime minister of india,the leader of the opposition in the lok sabha & chief justice of india.
